General terms

These Terms set forth the terms and conditions under which you may use our website and services/ products as offered by us. This website offers visitors services/ products and transactions on the platform. 

By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms and Conditions.

The user of the Website must be at least 18 years of age, or the legal age of majority in your jurisdiction, and you must have the legal authority, right and freedom to enter into a binding agreement with these Terms. You are not permitted to use this Website and/or obtain the Services if prohibited by any law or regulation in your country or applicable to you.

1. Katerina Jewellery online store sells products owned by Peterbaltic Art OÜ (hereinafter referred to as Products).

2. The terms and conditions apply to the legal relationships that arise between the customer (hereinafter the Customer) and Peterbaltic Art OÜ (hereinafter the Seller), the owner of the shopping environment located at the internet address www.katerinajewellery.com (hereinafter the e-store) in connection with the purchase of Products from the online store. In addition to these terms and conditions, the legal relationships arising from the purchase of Products from the online store are governed by the legislation in force in the Republic of Estonia.

3. Seller's details: Peterbaltic Art OÜ (reg. code 14165526, VAT EE102542932), registered address Mere tee 1, Tabasalu, Harku vald, 76901.

Prices

All prices displayed in the online shop are presented in euros and include VAT applicable in the Republic of Estonia. Seller has the right to change prices, and make discount offers.
​The fee for delivering the goods depends on the buyer's location and the method of delivery. The delivery fee is displayed to the buyer when completing the order.

Products

1. Products displayed in the online shop are available in stock or marked with possibility to preorder. The availability of said Products is not guaranteed, as it may be erroneous due to possible technical problems in the online store programs.

2. If the Customer places an order, but it appears that the given Product is out of stock, the online store will not be able to fulfill the given order. In this case, the Seller will contact the Customer and offer a replacement product, a possible new delivery time, or return the purchase amount to the Customer within 3 days at the latest.

3. The photos of the Products displayed in the e-shop are for illustrative purposes and may unintentionally differ slightly from the actual appearance of the Product.

Purchase process

1. The customer selects Product in the online store and adds it to the shopping cart by clicking the "Add to cart" button.

2. To complete the order, click on the "Continue to pay" button in the shopping cart, after which the Customer will be redirected to the order completion page. After entering the required data, the Customer pays for the Product via Credit/ Debit card (offered by Stripe.com) or by PayPal (offered by Paypal.com) or through Estonian bank links (offered by MakeCommerce or Maksekeskus).

3. After paying for the Product, the online store sends an order confirmation to the Customer's e-mail.

4. When completing the order, the customer has to make sure to fulfill right data of the order.

5. The Seller is not responsible for the impossibility of execution due to incorrect data provided by the Customer or any resulting consequences.

Right of withdrawal

1. You have the right to exchange or return the ordered product within 14 days. The 14-day period starts from when you received of the product.

2. To withdraw, it is necessary for the Customer to send a withdrawal request to the e-mail address info@katerinajewellery.com. You can find a statement HERE.

3. When returning goods, the principle applies that the return is made in the same way in which the goods were delivered to the buyer.

4. Seller is not obliged to compensate the Customer for the transportation costs incurred by the return.

5. The Seller will transfer the returned Product/Products, including delivery costs borne by the Customer, back to the Customer's bank account within 14 days from the receipt of the withdrawal request. The customer is obliged to deliver the returned goods to the seller within 14 days of sending the withdrawal statement. The e-store may refuse to issue refunds until the returned product(s) have been received back or until the buyer has provided proof of having returned the item, whichever occurs first. The Product to be returned must not be used, damaged, dirty or with other signs of use. The product must be complete (include the product packaging and all items included in the product packaging - manual, certificate, etc.).

6. If the goods have been used for a purpose other than what is necessary to verify the nature, characteristics and functioning of the goods, or if they show signs of use or wear, the e-shop has the right to reduce the refundable fee according to the decrease in the value of the goods.

Claims

1. Products sold in the online store are subject to the 2-year claim submission deadline stipulated in Section 218, subsection 2 of the Tax Code. Disagreements between the customer and the seller will be resolved through negotiations.

2. The customer has the right to contact the online store after finding out about faults within two months at the latest, by sending an e-mail to info@katerinajewellery.com.

3. If the goods purchased from the e-store have defects for which the Seller is responsible, the Seller will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Seller will return to the buyer all fees included in the sales contract.

4. The seller responds to the consumer's complaints as soon as possible, but no later than within 15 days from the receipt of the claim.

5. Pursuant to the provisions of § 222 (1) of the Law of Obligations Act, the Customer has the right to demand repair or replacement of the Product if the Product does not meet the contractual conditions. In the event of non-compliance of the Product with the contract conditions, the costs related to the repair of the Product or the replacement of the Product, in particular transport, postal, labor, travel and material costs, shall be borne by the Seller.

6. The Seller is not responsible for damages caused by the non-intended use of the ordered products, as well as for delivery delays, if this is due to circumstances beyond the Seller's control and/or due to force majeure beyond his control.

Liability

1. The seller and the customer are responsible to each other for the damage caused to the other party by violating these terms of use in the cases and to the extent provided by the legislation in force in the Republic of Estonia.

2. The seller is responsible to the extent of the sale price of the Product.

3. The customer undertakes to use the online store service only for purposes consistent with the law and good practices.

Terms and changing terms

1. By registering in the e-store or making a purchase, the Customer accepts the terms of use of the online store and undertakes to comply with them.

2. The sales contract between the Seller and the Customer enters into force from the receipt of the payable purchase amount to the Seller's current account.

3. The seller may change the terms of use of the online shop and the prices of the products without prior notice. Notice of changes will be published in the online shop environment. The prices and other conditions visible to the customer at the time of the transaction are applied to the transaction.

4. The seller reserves the right to cancel the order if the price of the Product displayed in the E-shop was incorrect due to a technical error.

Direct marketing and processing of personal data

a. The online store uses the personal data entered by the buyer only to process the order and send the goods to the buyer. The online store transmits personal data to companies providing transport services in order to deliver goods.

b. The online store sends the buyer newsletters and offers to the buyer's e-mail address only if the buyer has expressed his wish to do so by entering an e-mail address on the website and has indicated his wish to receive direct mail notifications.

c. By registering as a user on the website, you can manage your preferences for receiving notifications under your profile.

d. The buyer can opt out of offers and newsletters sent to e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.

Other Terms

1. Disagreements between the customer and the seller will be resolved through negotiations. In the event of failure to reach an agreement, the Customer can appeal to the Consumer Disputes Committee. The competence of the Consumer Disputes Committee is to resolve disputes arising from the contract concluded between the Customer and the Seller. Review of the customer's complaint by the commission is free of charge.

 

The customer can turn to the platform for resolving consumer disputes of the European Union.

Payment Methods

​Payment by credit/debit card.

Credit and debit card payments are mediated by the payment brokerage platform Stripe (stripe.com). Stripe's payment brokerage platform is one of the most popular and secure platforms in the world.

You can pay by entering your bank card number, name on the bank card and card security code. Card data can be stored for future use. All payment data are securely protected, as the website manager, the Online Store does not have access to them.

You can pay with both a debit card and a credit card.

An e-gift card purchased in the online store using the gift card's unique code.

If you have purchased or received a Webshop e-gift card as a gift, you can use it as a means of payment until the amount is paid. To use, enter the gift card's unique code when paying, which you will find in your gift card's e-mail.

The gift card is valid for 6 months after the delivery date.

Estonian bank payments Make Commerce: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Pocopay.

NB! When paying with a bank link, be sure to click the "Back to Merchant" button on the bank's page.

Payments are mediated by Maksekeskus AS. Payment is made outside the Webshop in a secure environment - when paying with a bank link, in the secure environment of the respective bank, and in the secure environment of Maksekeskus AS when paying with a credit card. The seller does not have access to the customer's bank and credit card data. ​

Peterbaltic Art OÜ is the responsible processor of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.

 

Paypal payment

Paypal payments are mediated by the payment intermediary platform Paypal (paypal.com). The customer creates an account on the Paypal platform and links his payment method. All payment data are securely protected, as the website manager, the Online Store does not have access to them.

Privacy Terms

1. General provisions

These privacy terms regulate the principles regarding the collection, processing and storage of personal data. Personal data is collected, processed and stored by Peterbaltic Art OÜ, the responsible personal data processor (hereinafter the data processor).

a. A data subject in the sense of the privacy terms is a customer or other natural person whose personal data is processed by the data processor.

b. A customer in the sense of the privacy terms is anyone who buys goods or services from the website of the data processor.

c. The data processor complies with the principles of data processing stipulated in legislation, among other things, the data processor processes personal data legally, fairly and securely. The data processor confirms that personal data has been processed in accordance with the provisions of legislation.

These data protection conditions have been drawn up in accordance with Regulation (EU) No. 2016/679 of the European Parliament and of the Council on the protection of natural persons in the processing of personal data and the free movement of such data and on the repeal of Directive 95/46 / EC / EC (General Regulation on the Protection of Personal Data), Personal Data Protection of the Republic of Estonia law and legislation of the Republic of Estonia and the European Union.

2.What types of information do we collect?

The personal data that the data processor collects, processes and stores is collected electronically, mainly via the website and e-mail. We receive, collect and store any information you enter on our website or otherwise provide to us.

a. By sharing his personal data, the data subject gives the data processor the right to collect, organize, use and manage personal data for the purposes specified in the privacy policy, which the data subject directly or indirectly shares with the data processor when purchasing goods or services on the website.

b. The data subject is responsible for ensuring that the data provided by him is accurate, correct and complete. Knowingly providing false information is considered a violation of the Privacy Policy. The data subject is obliged to immediately notify the data processor of changes in the provided data.

c. The data processor is not responsible for damage to the data subject or third parties caused by the data subject providing false information.

The data processor may process the following personal data of the data subject:

First and last name, telephone number, e-mail address, delivery address, current account number and name of the private or natural person who forwarded the payment, payment card details.

In addition, we collect the Internet Protocol (IP) address used by your computer to connect to the Internet; Log in; e-mail address; password; computer and connection information and purchase history.

We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to leave the page.

We also collect personally identifiable information (including name, email address, password, communication); payment information (including credit card information), comments, feedback, product reviews, recommendations and personal profile.

In addition to the above, the data processor has the right to collect data about the customer that are available in public registers. ​

The legal basis for the processing of personal data is Article 6(1)(a), (b), (c) and (f) of the General Regulation on the Protection of Personal Data:

a. the data subject has given his consent to process his personal data for one or more specific purposes;

b. the processing of personal data is necessary for the performance of a contract concluded with the participation of the data subject or for taking measures prior to the conclusion of the contract in accordance with the request of the data subject;

c. the processing of personal data is necessary to fulfill the legal obligation of the data controller;

f. processing of personal data is necessary in the case of a legitimate interest of the data controller or a third party, unless such interest is outweighed by the interests of the data subject or the fundamental rights and freedoms for which personal data must be protected, especially if the data subject is a child.

3. Why do we collect and store personal data for a long time?

a. To provide and manage orders, we store data for up to seven years after making a purchase.

b. To provide customer assistance, customer management and technical support, we store data for up to seven years after making a purchase.

c. To comply with applicable laws and regulations, including financial activities and accounting. we keep the data for 7 years after the last transaction.

d. In order to be able to contact our visitors and users with general or personalized service-related notices and advertising messages, we retain until the data subject expresses a wish to stop receiving the information.

 

Our company is hosted on the Wix.com platform. Wix.com provides us with an online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com's data storage, databases, and general Wix.com applications. They store your data on secure servers behind a firewall.

All direct payment gateways offered by Wix.com and used by our company comply with the standards established by PCI-DSS, which is managed by the PCI Security Standards Council, which is under brands such as Visa, MasterCard, American Express

4. Who do we share personal data with?

a. The data processor has the right to share customers' personal data with third parties, such as authorized data processors, accountants, transport and courier companies, companies providing transfer services. The data processor is the responsible processor of personal data.

The data processor transmits the personal data necessary for making payments to the authorized processor Maksekeskus AS and Stripe.com.

b. When processing and storing the personal data of the data subject, the data processor implements organizational and technical measures that ensure the protection of personal data against accidental or illegal destruction, modification, disclosure and any other illegal processing.

5. What are the rights of the data subject?

a. The data subject has the right to get access to his personal data and to consult them.

b. The data subject has the right to receive information about the processing of his personal data.

c. The data subject has the right to supplement or correct inaccurate data.

d. If the data processor processes the data subject's personal data on the basis of the data subject's consent, the data subject has the right to withdraw the consent at any time.

e. The data subject can contact our customer support at info@katerinajewellery.com to exercise their rights.

f. The data subject can file a complaint with the Data Protection Inspectorate to protect his rights.
